I won credit card dispute now merchant threatens collection/legal action. What do I do? What rights to I have?

I won a credit card charge dispute with an insurance company that filled out their paperwork improperly not covering equipment to be rented and therefore the rental company would not rent it. The insurance company say they don’t provide refunds once insurance is bound, but it was bound improperly and they did it at the last minute, went home and didn't answer calls so the equipment couldn't be rented because they didn’t fill it out properly to cover it. Regardless, the dispute was found in my favor hands down. I received an email from the insurance company threatening collections or legal action if I do not send a certified check. Is that legal? Is it just a scare tactic since it was already found in my favor? I am now tempted to sue them for the expenses it cost me because I could not rent the equipment I needed that weekend. (It was film gear for a short film) I assume they have no ground as otherwise credit disputes would be pointless. Any advice would be appreciated.

  1. When you say you won the dispute, what do you mean ? Did it go to court and they found in your favour ? If so, you can go back to the court and get the outcome enforced. Do not send the insurance company any more money. If you do not have court papers to support your position, get legal advice.
  2. Their just pissed at you coz not only did they try to rip you off they FAILED at doing it. So here are some options you might wanna consider. Ring the insurance company up see if they addmitt sending you the email, if they do, request for them to put their notice of intentions in writting so then it makes it offical & demand a copy to be mailed to your residental address within 7 days & tell them that any future contact to you is to be via this method only, if they will not do this or they dont do this you will know that their full of s**t which im sure everone already knows that they dont have a leg to stand on coz once a matter has been heard at a disputes court/tribunal the decision which is made is FINAL & that is why you need to get it in writting to be able to prove their still threatening you so that you can get their asses kicked for it otherwise they can deny any such threats to you, also block them from sending you any further emails. Ring the place where the matter was dealt with & ask them what you can do about it or another option is take it to the media that will that will stuff 'em'. Hope i was of some help to you & GOOD LUCK
  3. What do you mean you won the dispute? Do you mean in a court of law? If so the insurance company can't do anything, you should keep everything they send you and all messages they leave you and file suit against them. If the court says you're right then you don't owe them anything. If you mean you won a dispute with the credit bureau that means absolutely nothing.
