Credit Card dispute. Merchant threatens collections.?

This is to clarify an earlier question. I disputed a credit card charge from a merchant with my Credit Card company. The dispute was found in my favor, not in court, but by my credit card company and the merchants bank. The merchant is now threatening to send it to collections or take legal action. Doesn't disputing a charge and having it found in your favor take care of any legal or collection action? Otherwise merchants would do that all the time and there would be no point of credit card disputes and no consumer protection. Isn't this also coverd by the FTC? Thanks!

  2. don't know about the ftc, l thought thats what thats what dispute was for. check with your credit card about the threatened suit from the merchant. If you haven't already talk to the merchant yet to see if they will resolve this? I've never had to dispute because most merchants will allow credit for most reasons good luck to you.
  3. You need to understand that the credit card company only acts as a 3rd party in this transaction. If this is a "border line" dispute they would prefer to just give back the money and back out of it. But your transaction is with the merchant, not with the credit card company. Therefore if your merchant feels you are liable, he can take whatever action is necessary. If you still feel you are right, make him take you to court and dispute it. If he turns it over to collections, immediately dispute the charge and demand validation. Otherwise, they may put a hit on your credit report. If that happens (and you are still certain you could win in court) then file an action against them for posting unvalidated information on your credit report. You could win $1000 in such a lawsuit. Wish I would help you more, but without more details I can't give much more advice.
  4. The dispute resolution in your favor only applies to your credit card balance. They performed a "Chargeback" to the vendor in which you had a disputed item. The vendor can pursue the debt, take you to small claims, etc. I work for a large bank, I was in the Corporate/Business cards and loans division for a while, and chargebacks were a big think with commercial cards, but some vendors would still pursue the cardholders.
