can two people claim the same kids on their taxes?

I have two kids. last year my boyfriend and I agreed that he would claim the kids. The tax preparer also put down that I was also claiming the kids. I just realized that my tax forms from last year say that for the next ten years I would not be able to file for earned income credit. Is this legal and is there any way for me to dispute it. Also keep in mind that this was solely the tax preparers decision.

  1. Sorry, you have no recourse. Even if it was your tax preparers idea, you are responsible for checking the tax return before you sign it and mail it. The same child(ren) cannot be claimed on 2 different income tax returns and you knew your boyfriend was claiming the kids, so you should have told the tax preparer that they had already been claimed on anothers tax return.

  3. No, both can't claim the kids. Each one of you could claim one kid each. You are responsible to tell the tax preparer who you can legally claim. I don't know why he wouldn't tell you that you can't claim them if someone already has, unless you didn't tell him your bf claimed them or he's making money off you.(getting a percentage of your tax return.) Go to www.IRS.gov and get the IRS phone number and phone them to try to resolve it.
