2. Yes .. it is .... If you get caught then you will get charged... so don't get caught...
3. Yes, in many jurisdictions. It's theft of services. There has been an argument made that it also is a violation of federal anti-hacking laws - unauthorized use of a computer system - but I don't know of any prosecutions under that statute.
