
Can merchants bill you directly after a credit card dispute has been settled in your favor?
I bought a sectional sofa on JcPenny's website.It was delivered by truck to my home.The frame was split.I immediately called JcPenny to resolve.They wanted to bill me again to order a new sectional that wasnt even in stock yet.They say they don't do exchanges. They told me they would have the trucking co come back and pick it up and it could take up to 4 wks to get a credit.I called to dispute with my credit card.They tried to fight the dispute for a few months.I received a letter saying it had been settled in my favor from the cc company.Their trucking co. set up two appointments to pick it up and did two no call no shows.Yesterday I received a postcard-bill from jcpenny.

- It's ridiculous that they don't do exchange. However, if that is the policy, unfortunately that is. You don't need to pay it, if you don't want until you get the sofa picked up and get a credit for it. Just that they are not going to give you a new sofa until you do. Why don' t you start shopping somewhere else?
- Call them again and tell them that they need to come and get the sofa and stop billing you. If they persist then you need to send them a certified letter stating all the facts about the situation and containing all pertinent documents (photocopies only) and let them know in the letter that you are ready, willing and able to be at your home one more time for the truck to come. Make sure that you get the name and number of the trucking company and call them every five minutes if they fail to show up at their scheduled time. Persist in this behavior until they come. Call J.C. Penney's regularly also to ask for status. Document every phone call. Do not stop until the sofa has been removed from your home and you have a receipt from the truck driver. Send copies of all correspondence to the Better Business Bureau, JCPenney's corporate office, your local tv station and your state's attorney general's office. Finally, if all else fails, threaten a lawsuit.
- They can try to collect from you but may not bill your credit card or just remove money from a bank account [ if that's a debit card also] You are not obligated to pay the bill you can fight it but keep good record of all contact so if this shows on your credit report you can put an addendum on showing why you had reason to not pay it and do all contact in writing so you have evidence. Call a free legal aide office or consumer affair office in your area for state laws as this is regional and laws vary. Good luck
