
Does anyone know when it is legal to report a late on your credit report.?
My situation is this, I made a car payment by phone on 12/02/2007 it was due on the 3rd of November. I checked online to make sure it posted on 12/02/2007 I was not surprised that it had posted on 12/03/2007. My question is do you think this will affect my credit? I would like to dispute the financer if he puts it on my credit. The reason is 1) I made the payment on the 2nd. 2) it was within 30 days. 3) It is not my fault they give me the option to pay on a Sunday. I checked all through my paperwork and online disclosures and I did not find any notations to say any different than what I am thinking. Are there any credit expert lawyer that can help me. P.S. I called the financer and they said it looks like it will be reported What the issue is, is that i am in the middle of purchasing a home and I qaulify for the rate I have by 4 points. My mid credit score is 704 if I drop below I will not qualify for the same type loan and my interest rate will go up.

- Don't get all worked up about this. When you make your next payment on time and get caught up it will be marked "Current - was 30" This is about the most minor of derogatory indicators and won't take many points off your score. The points will add back on as this fades into the past. On the other hand, if this is not the only bad thing on the report and your credit is all screwed up, then one more little thing won't make a difference.
- Any creditor can legally report a late if payment is 1 day late. But unless I read this wrong, you were due on the 3rd & payment posted on the 3rd, so it's not late, right? Also most won't report lates until they are 30 days late. Have you already applied for the mortgage? Did they already pull your credit? If so you are in the clear. ps - if your auto loan financer is that big a jerk to report a one day late to credit bureaus you might look into refinancing your car with someone else. Good luck!
