What is needed to report a debt?

A collection agency called about a debt incurred in my name from an address where I have never resided. (apparently someone used my name to subscribe to dish network) Can they post this on my credit report, even though they don't have my SSN??? Isn't the burden of proof on them? Can I request copies of reciepts or forms I am supposed to have signed? They want ME to jump through hoops to dispute this. I'm tempted to just tell them to report me if they can. Advice? Thanks

  1. You may have to jump through hoops. The problem with dish network is they do ask for a SSN when subscribing, as with directv, someone who gave your name also gave yor SSN, you are a victim of identity theft. You may have to file a police report, yes you can ask to see copies of any contracts or signed authorizations.
  2. Yes, they can put the item on your credit report even without your SSN. You would then have to dispute it and go thru a few hoops to get it removed. Chances are the collector did a skip trace for someone with a similar name. Send them a certified, return receipt letter indicating this is not your debt and that you never lived at that residence. Request they provide validation of the debt to include copies of contracts or other documents that prove this is your debt. If they are unable to provide such documentation within 30 days, to cease and desist contacting you. They will probably go away. But don't be surprised if you get a phone call from another collection agency in a few months. Just send them another cease and desist letter. Be sure to check you credit report and dispute it if it shows up.
